Disagreeing with a housing benefit decision
What decisions can I disagree with?
You can usually disagree with decisions about:
• Whether you can get housing benefit.
• How much housing benefit you get.
• Whether you have been overpaid housing benefit.
• Whether you have to pay an overpayment back.
Some housing benefit decisions cannot be appealed to a tribunal. This means you cannot take them any further, even if you disagree.
You can't appeal decisions about:
• How the law is written or whether the rules are fair.
• How or when housing benefit is paid, such as payment dates or paying a landlord.
• A suspension of housing benefit
• Letters that give information but are not appealable decisions.
If a decision can't be appealed, the decision letter should tell you this. You may still be able to ask for the decision to be looked at again or make a complaint.
